These Terms of Service ("Terms") govern your use of our website, services, and platform (collectively, "Services"). By accessing or using our Services, you agree to these Terms. If you do not agree, please do not use our Services.
1. Acceptance of Terms
These Terms form a legal agreement between you ("User," "you") and Redstart Media, Inc. ("Top Engineer," "we," "us"). By registering, applying for jobs, or using our Services (free or paid), you confirm that you are at least 18 years old, have the legal capacity to enter this agreement, and accept these Terms. We may update these Terms periodically, notifying you via email or website notice. Continued use after changes indicates your acceptance.
2. Description of Services
Free Services: Job search, real-time job postings, thumbs up/down functionality, job alerts, and basic application support.
Paid Services: Proactive placement, career coaching, resume reviews, and exclusive career management tools (available via non-contract memberships).
Platform Features: Direct access to Top Recruiters, personalized job matching, and integration with employer networks (e.g., TopEmployer.net). We strive to provide accurate and reliable Services but do not guarantee job placement or specific outcomes.
3. User Accounts and Responsibilities
- Provide accurate, current, and complete information during registration and job applications.
- Maintain the security of your account by keeping your password confidential and notifying us immediately of unauthorized access.
- Update your profile to reflect changes in your qualifications or preferences.
- Use the Services lawfully and respectfully, avoiding any actions that harm our platform, other users, or our partners.
You are responsible for all activities under your account. We may suspend or terminate accounts for violations of these Terms.
4. User Content
When you submit resumes, profiles, feedback, or other content ("User Content"), you grant us a non-exclusive, worldwide, royalty-free license to use, store, display, and share your User Content to provide our Services (e.g., sharing your resume with employers). You represent that:
- Your User Content is accurate, lawful, and does not infringe on third-party rights.
- You have the right to share your User Content with us.
We may remove or modify User Content that violates these Terms or applicable laws. We do not claim ownership of your User Content but need these rights to operate our platform.
5. Paid Services and Payments
- Pay the fees outlined at checkout, as displayed on Top Engineer.
- Provide valid payment information and authorize recurring payments (if applicable).
- Review our refund policy, available at the Refund page linked in the footer, which governs cancellations and refunds.
We use secure third-party payment processors (e.g., Stripe) to handle transactions. You are responsible for any taxes associated with your payments. We may adjust fees with prior notice.
6. Intellectual Property
- All content on our platform (e.g., logos, text, design, software), except User Content, is owned by Redstart Media, Inc. or our licensors and protected by copyright, trademark, and other laws.
- You may not copy, modify, distribute, or reverse-engineer our content or software.
- You may not use our trademarks (e.g., "Top Engineer") without written permission.
- You may use our Services for personal, non-commercial purposes as intended (e.g., job searching, applying).
7. Prohibited Conduct
- Post false, misleading, or harmful User Content.
- Use automated tools (e.g., bots, scrapers) to access or extract data.
- Interfere with our platform's functionality (e.g., hacking, introducing viruses).
- Harass, threaten, or impersonate other users, recruiters, or employers.
- Use our Services for unauthorized commercial purposes (e.g., reselling job postings).
Violations may result in account suspension, termination, or legal action.
8. Governing Law
These Terms are governed by the laws of Florida, USA. Any disputes will be resolved through informal negotiation and, if necessary, binding arbitration in Tampa, Florida.
